Terms of Service

These terms govern your use of reclaimroi.com (the "site") and the Ai Discovery and Assessment service (the "service") provided by Reclaim ROI. Plain English, no surprises. If something is unclear, email hello@reclaimroi.com and we'll explain.

01Acceptance

By using the site, submitting an inquiry, or purchasing the service, you agree to these terms and to the Privacy Policy. If you don't agree, don't use the site or buy the service.

If you're agreeing on behalf of a business, you represent that you have the authority to do so. The business and the individual signing up are both bound by these terms.

You also represent that you're at least 18 years old, that the contact information you provide is accurate, and that you're not on a U.S. sanctions list or located in a country to which U.S. persons are prohibited from providing services.

02The service

Reclaim ROI offers an Ai Discovery and Assessment for small business owners. The service is a productized engagement, not an open-ended consulting relationship. It consists of:

Reclaim ROI is an independent consulting business. We are not a law firm, an accounting firm, a registered investment adviser, or a tax preparer. We do not provide legal, financial, tax, or accounting advice. The report identifies operational opportunities and quantifies their estimated value in hours and dollars; it is informational and is not a substitute for advice from a licensed professional in those domains. If a recommendation in the report has legal, tax, or financial implications for your business, talk to a qualified professional before acting on it.

We reserve the right to change, expand, or retire any feature of the service. If a change materially affects an active engagement, we'll notify you in writing first.

03Payment

The assessment is $1,500 USD, flat fee, paid in full upfront via Stripe at the time of booking. This price is the entire price for the service as described. There are no hourly add-ons, no expense reimbursements, no separate booking fees, and no automatic renewal.

Charges are non-refundable once the discovery call is completed. If you cancel before the call, contact us and we'll refund the fee in full minus any payment processing costs Stripe has already taken (typically under $50). If we cancel for any reason, you get a full refund.

What's included in the $1,500:

What's not included: implementation work, ongoing advisory, software licenses, third-party tool subscriptions, or anything that requires sustained access to your systems. If implementation makes sense, that's a separate engagement, quoted separately based on what you actually want built.

04Engagement scope

The service is bounded on purpose. The scope is:

05Intellectual property

The report is yours. Once we deliver it, you own the analysis, the recommendations, and the prioritization specific to your business. You can apply them, share them with your team and your advisors, hand them to another consultant or implementer, or ignore them. We grant you a perpetual, royalty-free license to use the contents of the report for any lawful purpose.

The methodology is ours. The diagnostic frameworks, the discovery agent's question set, the scoring model, the report templates, the prompts that drive analysis, and the underlying tooling are all Reclaim ROI's intellectual property. You don't get rights to those, and you agree not to extract, reverse-engineer, or republish them.

You may quote or summarize the report internally and to your advisors without restriction. If you want to publish the report or any substantive portion of it externally (case study, blog post, marketing material), email us first and we'll usually say yes with light attribution requirements.

Anything you tell us during discovery is yours; we're not claiming rights to your business information or operating details.

06Recording consent

The discovery call is recorded and transcribed for the sole purpose of building your report. Maryland is a two-party consent state, so the call opens with the agent disclosing the recording and asking you to say yes out loud to continue.

You can decline. If you do, the recording does not start, and we'll offer a text-based intake instead. You can also withdraw consent mid-call; the recording stops at that point and the partial audio is deleted within 24 hours.

07Limitation of liability

The assessment is informational. We do our best work to identify real opportunities and quantify them honestly, but the estimates in the report are estimates, not guarantees. Whether the projected savings actually materialize depends on your business, your team, your implementation choices, the tools you select, and a hundred other variables that are outside our control.

You are responsible for implementation decisions. If you act on a recommendation, you do so at your own discretion. We're not liable for the outcome of changes you make to your business based on the report, and you agree not to claim otherwise.

To the maximum extent allowed by law, our aggregate liability to you for any claim arising out of or related to the service is capped at the fee you paid us, which is $1,500. We're not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill, even if we were advised those damages were possible.

This limitation does not apply to liability that can't be limited under applicable law (gross negligence, willful misconduct, fraud, or violations of confidentiality obligations).

08Indemnification

You agree to indemnify and hold Reclaim ROI harmless from any third-party claim arising out of (a) your use of the service in violation of these terms, (b) your violation of applicable law, or (c) actions you take in your business based on the report.

We agree to indemnify and hold you harmless from any third-party claim that the report or the service, as delivered by us, infringes a U.S. copyright, trademark, or trade secret of a third party. If a claim like that comes in, we'll handle the defense at our expense and pay any settlement or judgment we agree to.

Either side will tell the other promptly when an indemnifiable claim arises and cooperate reasonably on the defense.

09Confidentiality

We don't share what you tell us during discovery. The contents of the call, the transcript, the report, and any business information you describe stay between you and us. We use that information only to deliver the service and to follow up about the engagement.

Exceptions: we may share information if you tell us to, if a subprocessor needs it to deliver the service (and only the minimum needed), or if a binding legal request compels us. In the legal-request case, we'll push back on overbroad requests and notify you unless legally prohibited from doing so.

You agree to keep our methodology, pricing, contract terms, and any non-public information you learn about Reclaim ROI confidential on the same basis. The report itself is not confidential to you; it's yours to share with anyone you want.

10Termination

You can stop using the site at any time. If you've paid for the service but haven't taken the discovery call yet, contact us to cancel and we'll refund as described in the Payment section.

We reserve the right to refuse service or terminate an engagement if (a) the business or use case violates these terms, (b) the work would be unethical, illegal, or otherwise outside our standards, (c) you behave abusively toward our team, or (d) we determine the assessment can't be honestly completed for your situation. If we terminate before delivering the report, you get a full refund. If we terminate after, we'll explain why and decide on a refund in good faith.

11Governing law

These terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules. Any dispute arising out of or related to the service that can't be resolved by talking it through will be brought in the state or federal courts located in Baltimore County, Maryland, and both sides consent to jurisdiction and venue there.

If any provision of these terms is held unenforceable, the rest of the terms stay in effect, and the unenforceable provision is interpreted to give effect to its intent to the extent allowed by law.

12Changes to these terms

We update this page when we change how the service works or what it costs. The "Last updated" date at the top reflects the most recent change. For substantive changes (price, scope, liability, governing law), we'll email active leads and clients with a summary of what changed and what it means for them. Continued use of the site or the service after a change means you accept the updated terms. The version of the terms in effect at the time you book the service is the version that governs that engagement.
